安裝、存取或使用任何網站、行動apps(應用程式)、電郵新聞信及訂閱,以及其他有張貼或提到這些條款的其他數位功能(合稱「線上服務」),您就與麥當勞授權發展商和德昌股份有限公司(「麥當勞」或「我們」)成立了具有拘束力的合約,由位於台北市中正區林森南路一號3樓之總部負責控制及運作。
您也應該審視我們的隱私權聲明,該聲明說明我們是如何蒐集、使用及共享資料。
若您尚未年滿十八歲,您就必須和您的父母或監護人一起審視這些條款。您的父母或監護人必須瞭解並同意這些條款,您才可以使用線上服務。
如果您或您的父母或監護人不同意這些條款,那您就必須立即停止使用線上服務,並要求麥當勞關閉您所設立的任何線上服務帳號。有關關閉或刪除帳號,請參考「1.有關線上服務>如何聯繫我們」的條文,並提供所欲刪除帳號之電子郵件資訊。
您應對於您的裝置和帳號負責。您應自行負責使用線上服務所需之任何裝置、軟體及服務。麥當勞並不保證線上服務在任何特定的裝置上或與任何特定的軟體一同使用會具有完全的功能。您亦應自行負責使用線上服務時的任何傳訊及數據傳輸費用、收費與稅金,其中包括我們用您選擇的簡訊、電子郵件或其他方式和您進行的通訊。您只能使用您所擁有或控制的裝置使用線上服務,您也只能使用經過授權的作業系統(例如,蘋果裝置使用蘋果iPhone OS)使用線上服務。如果您設立一個線上服務帳號,您應自行負責保持該帳號以及利用該帳號進行所有活動的安全性,並必須時時保持帳號資料的正確。
麥當勞更新或終止線上服務的權利。您瞭解並同意,(不論有無通知)麥當勞得隨時更新、修改或終止線上服務(或您對線上服務的存取利用),其中包括對您裝置上安裝之任何麥當勞行動app應用程式的推播更新(或將功能移除或將使用應用程式的存取移除)。
條款更新。麥當勞亦得隨時自行決定更新條款。如果麥當勞對條款做重大的變更,我們會以任何合理的方式通知您,例如在線上服務上張貼新的條款。如果您不同意變更後的條款,您就必須立即停止使用線上服務,並要求麥當勞關閉您所設立的任何線上服務帳號。有關關閉或刪除帳號,請參考「1.有關線上服務>如何聯繫我們」的條文,並提供所欲刪除帳號之電子郵件資訊。
麥當勞隱私權保護聲明。麥當勞隱私權保護聲明(https://www.mcdonalds.com/tw/zh-tw/privacy-policy.html)說明我們處理資料的做法,其中包括我們如何蒐集、使用及分享資料。
我們如何和您進行通訊。透過線上服務,您可以選擇同意接收電子郵件、用您提供給我們的行動電話號碼接收簡訊、或接收來自於我們的推播通知。如果您選擇同意這些通訊方式,您瞭解並同意您會收到來自於麥當勞的行銷、交易及其他的訊息。 麥當勞得依隱私權保護聲明,使用您提供給我們的資訊和您進行通訊。
選擇退出通訊的通則。您可以選擇我們和您進行通訊的方式。您通常可以在使用的線上服務個人資料欄位找到通訊偏好以及如何選擇退出的說明。您也可以利用您裝置的設定功能,變更您的通訊偏好。此外,我們的通訊方式本身也有選擇退出的功能。您瞭解並同意,您可能需要針對不同的通訊方法,個別管理您的通訊偏好。例如,如果您選擇退出接收行銷電郵,您可能仍因選擇同意接收簡訊而仍會收到行銷簡訊。在我們竭盡所能提供便利的方法讓您管理您通訊偏好的同時,您仍然需要為各種線上服務調整您的通訊偏好。請注意,對於某些與帳號相關以及交易相關的通訊而言,停止接收這些通訊的唯一辦法,可能就是關閉您的線上服務帳號。
麥當勞會員計畫-M Point
如您以麥當勞APP帳號密碼登入歡樂送線上訂餐,單筆消費金額每NT$1元可獲贈1個M Point(NT$20元可獲贈20個 M Point…以此類推)。消費獲贈之M Point會在當筆消費時間24小時內由系統派送至會員帳號中c網路斷線等特殊因素除外)並可在麥當勞APP中的會員紀錄查詢。所有資料均以麥當勞系統最終紀錄為準。
M Point有效期限為獲得後的次年該月底前有效(例如:於2023年10月26日獲得20 個M Point,則該20 個M Point有效期限為2024年10月31日止,以此類推),M Point過期後即失效,恕無法展延,因此請注意於M Point到期前完成回饋券之兌換。
麥當勞將不定期舉辦額外M Point獎勵活動。有關任何獎勵活動或促銷活動的更多訊息將在該活動或促銷活動的相關條款中提供。
每個帳號的上限為50,000 個M Point。一旦您達到最高M Point額度後,後續的交易將無法再獲取M Point。麥當勞有權更改M Point相關限制與條款,並可在事先通知或未事先通知的情況下進行更改。
部分餐廳不適用,請以官網公告為主。
您透過麥當勞APP會員之消費或參與活動後所累積的M Point,將可用以兌換回饋券,即在麥當勞APP內使用M Point不定期兌換指定回饋產品,回饋券只能在餐廳的點餐櫃檯、自助點餐機或得來速使用,歡樂送恕不適用。
任何時候因任何原因將一筆消費退貨,並退還全額或部分新台幣,我們將有權扣除該退貨相應之M Point。消費換貨亦同,但若換貨後的產品價值相同或更高者除外。

一經透過網路訂餐系統或電話訂餐服務提交任何訂單,您聲明及保証您有能力了解、同意及遵守本條款。您應提供真實、準確及齊全的訂購資料。所有經網路或電話訂餐服務所提供的資訊將適用本條款。
因應麥當勞會員計畫,2023年10月26日15:00起原麥當勞歡樂送會員帳號將無法再登入,須重新註冊升級成為麥當勞APP會員帳號,方可繼續點餐。
如何註冊成為麥當勞APP會員帳號,可參考以下說明:
您曾註冊過歡樂送會員帳號,但尚未下載麥當勞APP,亦尚未重新註冊升級成為麥當勞APP會員。 您曾註冊過的歡樂送會員帳號(例: [email protected])於2023/10/26 15:00起將無法再登入,須重新註冊,完成升級成為麥當勞APP會員,方可繼續點餐。 建議您可前往歡樂送訂餐平台,點選<立即註冊>,並使用您原註冊之歡樂送帳號(例: [email protected])再次重新註冊,升級您的會員身份成為麥當勞APP會員,即可保留您過往於歡樂送訂餐平台之重要資訊(地址庫、我的最愛、訂餐歷史紀錄以及信用卡綁定資料等)。 未來您也可以使用此帳號(例: [email protected])登入麥當勞APP,享受全面會員權益及訂購歡樂送。

您已下載麥當勞APP,並已完成註冊成為麥當勞APP會員,但未曾於歡樂送平台註冊或訂餐 現在您可使用麥當勞APP會員帳號,登入以下麥當勞數位平台:歡樂送網路訂餐網站、歡樂送APP及麥當勞APP來訂購歡樂送。
您尚未成為麥當勞APP會員,也未曾於歡樂送平台註冊或訂餐 建議立即先下載麥當勞APP並註冊成為麥當勞APP會員,以享受全新會員體驗與會員獎勵制度。
若您希望加速點購歡樂送 您可使用免註冊訂餐功能,但支付方式將由系統自動為您指定,且不接受麥當勞禮券,亦無法讓您於歡樂送的消費享累積M Point。但若您想自行選擇支付方式或希望歡樂送消費可累積M Point,建議您註冊成為麥當勞APP會員登入後再訂餐,並享受全新會員體驗與會員獎勵制度。
訂購
您將會以您的用戶名稱帳號作出的每項網路訂餐負法律責任,並同意就使用您的用戶名稱提交訂單之人的行為(包括第三者未經授權而使用您的電子郵件地址)所造成的一切損失向麥當勞提供賠償。
麥當勞若就某項訂單檢查用戶紀錄後,認為該訂單不可信賴,則保留拒絕接受該項訂單的權利。
每一筆訂單,須支付新台幣$39元之外送服務費用。
外送服務只限台灣特定區域。詳情請致電歡樂送®專線02-40666888查詢。
依據餐廳營業時段,部分餐廳無法24hr提供外送服務。
不同時段將提供不同食品。透過網上或電話訂購服務,早餐時段最後下單時間為早上10時15分,一般時段最後下單時間為早上04點45分前。
每筆訂單發票將由各外送餐廳開立並提供給顧客。
圖片僅供參考,產品內容、價格、包裝、餐具、供應時間、數量及口味以各麥當勞餐廳實際供應為準,數量有限,售完為止。歡樂送服務之產品價格與供應時間以歡樂送價目表與公告為準;部分麥當勞產品於歡樂送不販售,供應情形以實際為準。
送貨
透過網路或電話訂餐服務,我們的送貨時間為24小時(部分餐廳除外),送貨區域將不時更新,您所訂購之餐點將送至輸入地址之門口。您的送貨地址如有更改,您必須於訂餐前通知麥當勞,否則麥當勞將不會為送貨至錯誤或過時的地址負責。
如遇惡劣天氣、交通及/或其他不可控制的情況,外送服務將可能遲延。在因颱風或其他狀況,停止上班上課時,外送服務將暫停。
麥當勞雖會盡力確保正確地及滿意地完成您透過網路或電話訂餐服務提交的訂單,但若我們因缺乏某產品,或因產品出現不可預見的轉變,或因惡劣天氣、交通或其他不可控制的情況而不能供應訂單內部分或全部食品,則麥當勞保留拒絕完成全部或部分訂單的權利。
麥當勞歡樂送為了提供快速的送餐服務,將與第三方代送服務合作 (pandago / UberDirect),讓您的外送餐點在尖峰時間也能快速送達。
麥當勞歡樂送嚴格把關第三方代送的外送員品質,為您遴選高評分、且服務記錄良好的外送員 。送餐過程中,將以簡訊通知您訂單狀態,方便您即時追蹤訂單。
若餐點有任何問題,麥當勞歡樂送確保您的售後服務權益不變,如需要任何協助,您可以與配送餐廳聯繫,我們將竭誠為您服務。
付款
透過電話訂餐服務訂購的產品貨款,應於交貨時用新台幣現金或麥當勞禮券付款,電話訂餐服務不適用消費獲贈M Point。
透過網路訂餐服務,您可使用系統所支援之支付方式線上付款,或使用新台幣現金於交貨時付款;麥當勞點點卡不適用。
信用卡接受VISA、MasterCard、 JCB與American Express ,簽帳金融卡僅接受麥當勞信用卡小額支付參加機構之簽帳金融卡。參加機構名單請參考: https://www.mcdonalds.com/tw/zh-tw/digital/payment/credit-card.html
當您使用信用卡付款時,即表示您同意您的個人資料如姓名及信用卡號可能被麥當勞以外的第三方(位於台灣或海外之信用卡公司、發卡銀行及付款交易平台)於符合他們的資料隱私政策的方式處理信用卡付款交易使用。
若您使用免註冊訂餐功能,支付方式將由系統自動為您指定,且不接受麥當勞禮券。免註冊訂餐僅需提供您的行動電話號碼進行驗證,若需要訂單進度追蹤確認單,請提供您的電子郵件。
部分區域僅適用新台幣現金付款,麥當勞可隨時更改網路或電話訂餐的付款方式。
若因網路連線問題訂單失敗而刷卡已扣款,信用卡額度取消或簽帳金融卡退款流程將視各銀行作業流程為準
網路訂餐不提供金額新台幣30,000元以上訂單,請改致電歡樂送專線(02)40-666-888,進行訂餐;網路訂餐金額若為新台幣3,000元以上僅接受以線上刷卡方式支付。
麥當勞的智慧財產所有權。線上服務中的任何權利,都是麥當勞或其授權人的專屬財產。「線上服務」包含任何及所有線上服務的內容,例如但不限於文字、影像、圖畫、標誌、標頭、按鈕標籤、圖像、語音剪輯、數位下載、資料彙整、軟體、商標、服務商標、商業表徵、音訊、視訊、資料及其他材料(合稱「內容」),以及線上服務中的任何部分。條款的任何內容,均非意圖將任何權利移轉或歸屬給您。您不得採取任何行動去影響、限制或干擾麥當勞或其授權人的權利。
您可使用線上服務的授權。您於個人使用之目的範圍內,被授予一非專屬、個人、不得轉讓及可撤銷的授權,並可依條款之規定使用線上服務,不得用於商業用途。「使用」包括存取、互動及展示。除條款所明確賦予您的授權與權利外,並無以默示的方式賦予您任何的授權與權利。麥當勞並保留所有其他權利。
商標資訊。商標、服務商標及所有的圖像元素,其中包括線上服務的外觀及其體驗感受,都是麥當勞或授權人所專有並受到保護的商標或商業表徵。線上服務另外亦可能包含分屬不同第三方之名稱、商標及服務商標,而係其各自所有的財產。
可接受的使用及其他限制。您不得以下列方式使用線上服務(包括內容在內),亦不得允許第三方有下列的行為:
以不合法或條款所禁止的任何目的而使用線上服務;
刪除或變更任何著作權、商標或其他的所有權聲明;
企圖取得包括其內容在內之線上服務的所有權或任何產權;
以任何商業方式使用、拷貝、散播、再刊行、展示、揭露、上傳、張貼或傳送線上服務;
租賃、出租、販售、再授權、借貸、翻譯、合併、改編、讓與或轉讓線上服務,或與任何其他的程式或服務結合或整合;
反匯編(disassemble)、反編譯(decompile)、逆向工程(reverse-engineer)、拷貝來源碼或目的碼格式,或根據線上服務製作衍生性作品;
因移轉、提供、出口或再出口線上服務,而違反禁運、貿易制裁或其他技術管制或出口法令;您另外並陳述且保證,您不是 (i) 位在受美國政府禁運或被美國政府指定為「支援恐怖分子」的國家內;或 (ii) 被列在任何美國政府禁止或限制之對象的名單內;
使用任何未經授權的技術或自動化系統存取線上服務或擷取線上服務的內容,其中包括但不限於網路爬蟲(spiders)、網路機器人(robots)、螢幕擷取器(screen scrapers)或離線閱讀器(offline readers);
企圖使線上服務無法運作、損壞、過載、使受損,及未經授權存取線上服務、麥當勞網路或與線上服務相關的任何用戶帳號。
麥當勞責任限制。任何直接或間接的損失利潤或業績的損害賠償、特別、間接、結果性、懲罰性或附帶損害賠償,不論麥當勞或麥當勞體系的任何其他成員均不負責,其中包括與線上服務相關,或因線上服務所致生之資料損失、人身傷害或財產損害。本條的任何內容,均非意圖限制麥當勞因麥當勞之重大過失或惡意或不法的行為所造成的損害賠償責任。此外,本條的任何內容,均非意圖限制或改變您身為顧客,依適用法律不能加以限制或改變的權利。麥當勞保留所有合法的權利,得依這些條款或依法律之許可,請求損害賠償或其他的賠償。
麥當勞是以「原樣」提供線上服務,並無任何保證。線上服務可能會有不正確或錯誤的地方。麥當勞是以「原樣」提供線上服務,並無任何明示或默示的保證。麥當勞否認所有對於適銷性及適合特定目的的保證。麥當勞並不保證、亦未表示線上服務是正確、可信賴、不會中斷、無錯誤、或瑕疵會被改正,或線上服務無病毒或其他有害的元素。有關您之使用線上服務,您應承擔全部的責任。如果對線上服務不滿意,您對麥當勞的唯一救濟,就是停止使用。此項救濟的限制,是您與麥當勞協議的一部分。
第三方服務。線上服務可能會連結到或允許您使用第三方網站、可下載的材料、內容、社群網路或其他的數位服務(合稱「第三方服務」)。這些第三方可能會有他們自己的條款和條件或隱私權政策,您在使用之前必須先審視及瞭解。麥當勞與任何該第三方均無關聯性,亦不認可任何第三方服務。對於因這些第三方服務所致生或與之相關的任何損失或損害,麥當勞均無責任。
非我們所能控制的情事。因麥當勞無法合理控制的任何情事所造成或與之有關,導致麥當勞因而未能履行條款對其所規定的任何義務,則麥當勞無責任。如有各該情事發生,則麥當勞依條款應盡之義務,在各該情事進行期間將中止;麥當勞雖無義務,但得盡合理的努力想辦法解決,以使得儘管有各該情事,仍得履行其依條款應盡之義務。
這些條款內含並補充蘋果公司(Apple Inc.)的條款和條件(請參閱http://www.apple.com/legal/itunes/us/terms.html#service)包括其中的「的授權應用程式終端使用者條款(「蘋果條款」),以及谷歌公司(Google Inc.)的系統以及谷歌市場 (Google Play)服務條款(請參閱http://play.google.com/about/play-terms.html)。如果您是透過蘋果或谷歌應用程式使用線上服務,您也承認並同意: 對於提供有關蘋果/谷歌應用程式的任何支援和維護服務,蘋果/谷歌並無任何的義務。如果您有任何有關蘋果/谷歌應用程式Apps維護和支援的問題,請使用前述的支援服務與麥當勞聯絡,而非與蘋果/谷歌聯絡; 除非這些條款中另有其他明確的規定,有關擁有或使用蘋果/谷歌應用程式的任何求償,是您和麥當勞之間的事(而非不是您或其他任何人與蘋果/谷歌之間的事); 如果因為您擁有或(依這些條款)使用蘋果/谷歌應用程式而侵害任何智慧財產權,致使第三方有任何的求償,則有關該求償,蘋果/谷歌對您不負責亦無責任; 如果您購買的蘋果/谷歌應用程式並不符合其可適用的任何保固,您可以通知蘋果/谷歌蘋果,則蘋果/谷歌可能會依當時有效的蘋果/谷歌條款和條件,蘋果/谷歌可能會將蘋果/谷歌應用程式的購買價退還給您。依此原則,並在法律許可的最大範圍內,蘋果/谷歌並未提供或簽訂成立任何與蘋果/谷歌應用程式有關的保證、條件或其他條款,對於有關蘋果/谷歌應用程式,或因您或任何人使用蘋果/谷歌應用程式,或因信賴其中之任何內容,因而所造成的任何求償、損失、支出或任何性質的費用,蘋果/谷歌將無需對您負責。
麥當勞並未做任何陳述表示線上服務適合或可於中華民國以外的地方使用。如果您從其他地方使用線上服務,您應負責遵守當地應適用的法律。
這些條款的準據法是中華民國法律,並應據以解釋之,而不論任何法律衝突原則。如因條款或線上服務所致生或與之有關的任何法律訴訟,您不可撤銷地同意,應以臺北地方法院為第一審管轄法院。
雖然這些條款僅規範麥當勞與您之間的線上服務事宜(且雖然蘋果/谷哥及麥當勞體系的任何其他成員並非這些條款的當事人,然而蘋果/谷哥及麥當勞體系的任何其他成員依條款是第三人受益人,如果各該條款涉及他們,他們就有權對您行使麥當勞依這些條款所享有的各該權利)
這些條款內中英文內容若存有任何歧異,概以中文內容為準。
這些條款終止時,或允許您使用之線上服務終止時,依條款賦予您的相關權利應即終止;不過,您先前之使用線上服務,以及因各該使用所致生或與之有關的任何作為,仍應繼續適用這些條款。上述終止之時,麥當勞及麥當勞體系其他成員的所有權利,其中包括所有的智慧財產權、專有性權利及條款的授權應繼續適用,此外有關所有使用線上服務的限制、所有的責任限制與免責、以及本條關於準據法及管轄之約定,亦均應繼續適用。
這些條款中的各條條款和條件都具有可分性並單獨操作。如果其中有任何的條款和條件不合法、無效或無法履行,則其餘的條款和條件仍然依然有完全的效力。
如果麥當勞未堅持您必須履行條款對您所規定的任何義務,或如果麥當勞未對您行使其權利或遲延行使,並非意味麥當勞對您放棄其權利,亦非意味您無須遵守各該義務。
麥當勞得將條款對其所規定的權利與義務轉讓給其他組織或實體,但這樣做不會影響條款賦予您的權利或我們應履行的義務。您只有在麥當勞書面同意的情況下,才可以將條款對您所規定的權利或義務轉讓給其他人。
IMPORTANT: PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS AND CONDITIONS ("TERMS"). THEY CONTAIN LIMITATIONS ON McDONALD'S LIABILITY AND OTHER PROVISIONS THAT AFFECT YOUR RIGHTS.
By installing, accessing or using any websites, mobile apps, email newsletters and subscriptions, and other digital properties on which these terms are posted or referenced (together, "online services"), you are entering into a binding agreement with McDonald's developmental licensee PROSPECT HOSPITALITY CO., LTD. ("McDonald's", "we" or "us"), which it controls and operates from its headquarters at 3F, No.1, LinSen S.Rd., Zhongzheng District, Taipei, Taiwan (R.O.C.).
You should also review our Privacy Statement which describes how we collect, use and share information.
The online services are not intended to be used by, or targeted to, anyone under the age of 18. You must be at least 18 years old to use the online services. If you are not yet 18 years old (or the legal age of majority if different in your jurisdiction), then you must review these terms with your parent or guardian and they must understand and agree to these terms in order for you to use the online services.
If you or your parent or guardian do not agree to these terms, then you must immediately stop using the online services and request that McDonald's close any online services account that you have created. Please refer to "1. About the online services > How to contact us" for requesting account deletion, please also include the email address of the account that you want deleted.
You are responsible for your devices and accounts. You are responsible for any devices, software and services needed to use the online services. McDonald’s does not guarantee that the online services will fully function on any particular device or with any particular software. You are also responsible for any messaging and data charges, fees and taxes for your use of the online services, including when we communicate with you by text, email or other means that you choose. You may only use the online services with devices that you own or control and using only the authorized operating system (e.g., Apple iPhone OS for Apple devices). If you create an online services account, you are responsible for keeping the account secure and for all activity under the account. You must keep your account information accurate at all times.
McDonald's right to update or terminate the online services. You understand and consent that (with or without notice) McDonald's may update, modify or terminate the online services (or your access to them) from time to time, including by pushing updates to (or removing functionality or access from) any McDonald’s mobile app that you have installed on your device.
Updates to these terms. McDonald's may also update these terms at any time and at its sole discretion. If McDonald's makes material changes to the terms, we will notify you by any reasonable means such as by posting the new terms in the online service. If you do not agree to the changed terms, then you must immediately stop using the online services and request that McDonald's close any online services account that you have created. To close or delete your account, please refer to "1. About the online services > How to contact us" and include the email address of the account that you want deleted as well.
McDonald's Privacy Statement. The McDonald's Privacy Statement (https://www.mcdonalds.com/tw/zh-tw/privacy-policy.html) describes our information practices, including how we collect, use and share information.
How we communicate with you. Through the online services, you may opt in to receive emails, text messages to the mobile number you provide to us or push notifications from McDonald's. When you opt in to any of these types of communications, you understand and consent that that you will receive marketing, transactional and other messages from McDonald's. McDonald's may use the information you have provided to us to communicate with you in accordance with McDonald's Privacy Statement.
Opting out of communications generally. You have a choice in how we communicate with you. You can generally find your communication preferences with instructions on how to opt out in the profile section of the online service that you use. You may also have the ability to change your communication preferences using your device settings. In addition, our communications themselves may include the opportunity to opt out. You understand and agree that you may need to separately manage your communication preferences for each communication method. For example, if you opt out of receiving marketing emails, you may still receive marketing text messages if you've opted in to receiving them. Whilst we do our best to offer convenient methods for you to manage your communications preferences, you may need to separately adjust your preferences for each online service. Please note that for some account-related and transactional communications, the only way to stop receiving these communications may be to close your online services account.
Benefits for McDonald’s members - M Point
When you use the same account user name and password to log in to McDelivery Service to order, each NT$1 of spend may earn 1 M Point (i.e. NT$20 will earn 20 M Point, and so on). The system will distribute M Point earned into your membership account within 24 hours after transaction (excluding special factors such as network disconnection), which can be found under the membership records in the McDonald’s APP. All transaction records are subject to final records in the McDonald's system.
M Point expire at the end of the month after the year earned. (e.g., for 20 M Point obtained on October 26, 2023, these 20 M Point will be valid till October 31, 2024, and so on). No extension can be made post the expiry date of M Point. Therefore, please be aware to redeem your rewards prior to expiry of the M Point.
From time to time, McDonald’s may offer bonus campaigns or M Point accelerators that allow you to earn M Point in new and different ways. Further information regarding any bonus campaign or promotions shall be made available in the context of such campaign or promotion.
Your account holds a maximum of 50,000 M Point at any one time. Once you have reached the maximum M Point, no more M Point will be granted from subsequent transactions. McDonald’s is entitled to amend relevant constraints and terms on M Point. Such an amendment can be implemented with or without notification in advance.

Your M Point earned from purchases or participating in member exclusive events through the McDonald's APP can be used to redeem free products in the rewards menu, which may change from time to time. The reward items can only be redeemed at the restaurant counter, Self-Order Kiosk or Drive Thru, and are not applicable for "McDelivery" service.
McDonald's is entitled to remove M Point at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products included in the loyalty scheme with an equivalent points value. The same applies to the exchange of purchased products, except for products of the same or higher value.

Registration
By registering for the web ordering system or by ordering from us through the web or telephone ordering service, you represent and warrant that you have the capacity to understand, agree to and comply with these Terms and Conditions. You should provide true, accurate and complete ordering information. All information submitted to or received through web or telephone ordering will be subject to these Terms and Conditions.
In line with the McDonald's Loyalty Program, starting from October 26, 2023, at 3:00 PM, existing McDonald's McDelivery member accounts will no longer be accessible. To continue placing orders, you must re-register and upgrade to a McDonald's APP membership account.

You have previously registered for a McDelivery account, but you have not yet downloaded the McDonald's APP, nor have you re-registered to upgrade to a McDonald's APP membership account. Your previously registered McDelivery membership account (e.g., [email protected]) will no longer be accessible starting from 3:00 PM on October 26, 2023. You will need to re-register and complete the upgrade to become a McDonald's APP membership account in order to continue placing orders. We recommend that you visit the McDelivery ordering platform, click on "Register Now", and use your original McDelivery membership account (e.g., [email protected]) to re-register and upgrade your membership to become a McDonald's APP membership account. This will allow you to retain important information from your past use of the McDelivery ordering platform, such as your address book, favorites, order history, and credit card binding data, among other things. In the future, you can also use this account (e.g., [email protected]) to log in to the McDonald's APP and enjoy full member privileges and place McDelivery orders.
You have previously registered as a McDelivery membership account and have also downloaded the McDonald's APP, registering as a McDonald's APP membership account. If your account on both platforms is the same (e.g., both are [email protected]), you can use this account to log in to all McDonald's digital platforms. The system will preserve your important information from your past use of the McDelivery ordering platform, including your address book, favorites, order history, and credit card data. If your account on both platforms is different (e.g., your original McDelivery membership account is [email protected], but your McDonald's APP registered account is [email protected]), we recommend that you use your McDonald's APP membership account ([email protected]) to log in in the future. However, the system will identify you as a new member on the McDelivery platform, so it won't be able to retain your past information. You'll need to enter your ordering information again (address book, favorites, order history, and credit card data, etc.).
You have already downloaded the McDonald's APP and completed registration as a McDonald's APP membership account, but you have not previously registered or placed orders on the McDelivery platform. Now you can use your McDonald's APP membership account to log in to the following McDonald's digital platforms: McDelivery online ordering website, McDelivery APP, and McDonald's APP to place McDelivery orders.
You have not yet become a McDonald's APP membership account and have not previously registered or placed orders on the McDelivery platform. We recommend you download the McDonald's APP and registering as a McDonald's APP membership account to enjoy a brand new member experience and member reward system.
If you wish to expedite your McDelivery order: You can use the guest checkout feature, but the payment type will be automatically designated by system, McDonald's® Gift Certificates will not be accepted, nor does it allow you to accumulate M Points for your McDelivery purchases. Ordering
You will be liable for every web order made under your username and agree to indemnify McDonald's for all claims arising from the actions of a person submitting any order using your username (including the unauthorized use of your email address by a third party).
McDonald's reserves the right to decline to accept any order we may, in our opinion, consider unreliable upon checking the user's history for that particular order.
Delivery surcharge of NT$39 will be levied on any order.

Some restaurants cannot provide 24 hour delivery service according to the operating time.
Different food and beverage items are available at different times. Breakfast menu orders are taken until 10:15am and regular menu orders are taken until 4:45am via web or telephone ordering.
Each order invoice will be issued by the restaurant and provide to the customer.

Deliveries
Deliveries for the web or telephone ordering service are available 24 hours in selected areas of Taiwan which are subject to change from time to time and the meal you ordered will be delivered to the submitted the address. You must notify McDonald's of a change to your delivery address before placing an order and if you fail to do so we will not be responsible for deliveries to an incorrect or outdated address.
Delivery service may be delayed in the event of bad weather, traffic and/or uncontrollable conditions. Delivery service will be suspended during red or black rainstorm warning, typhoon.
Whilst McDonald's will use our best efforts to ensure that your order submitted through the web or telephone ordering service is correctly and satisfactorily fulfilled, McDonald's reserves the right to decline to fulfill an order in whole or in part if we are unable to supply some or all items of an order because of unavailability or any unforeseen change of the products, or in the event of bad weather, traffic and/or any uncontrollable conditions.
To ensure your meals are delivered as quickly as possible, McDonald‘s McDelivery may engage third-party delivery services (such as pandago or Uber Direct) to deliver your order. McDelivery strictly controls the quality of third-party delivery service and selects rider with high ratings and good service records for you. During the delivery process, you will be notified of the order status via text message, allowing you to track your order in real time. If there are any problems with the meal, McDelivery ensures that your service rights remain unchanged. If you need any assistance, you can contact the delivery restaurant and we will serve you wholeheartedly.
Payment
For orders via our call center, only cash payment and McDonald's Certificated will be accepted. Please note that the orders via our call center does not qualify for earning M Point.
Through the online ordering, you can make payments online using the payment supported by the system, or you can pay with cash, McDonald's prepaid card is not applicable.

When payment is made by credit card , you acknowledge agree and consent that your personal data such as your name and credit card number may be disclosed to third parties (located within and outside of Taiwan) processing such credit card transactions, including credit card companies, banks and payment gateways, and, subject to their respective personal data privacy policies and applicable laws, may be used, processed and stored by such third parties to facilitate payments that you now or subsequently make for orders placed.
Consumers are able to order without an account with our guest ordering service. Under this circumstance, the payment type will be automatically designated by system. McDonald's® Gift Certificates will not be accepted. When using guest ordering service, please provide your mobile number to receive verification code. If you need an e-mail confirmation of your order, please provide your e-mail address.
McDonald's may change at any time the method by which payments for web or telephone orders may be made and McDonald's will revise these Terms and Conditions to this effect by updating this posting.
If the order was failed ,yet the credit/debit card had been charged, the refund process will differ according to banks' policy.
Any order with an amount exceeding NT$3,000 cannot be processed through web ordering. Please make an order via the telephone ordering service by calling (02)40-666-888. Web ordering amount over NT$3,000, only accept online credit card service.
McDonald's intellectual property ownership. Any and all rights in the online services are and shall remain the exclusive property of McDonald's or its licensors. For purposes of clarity, "online services" includes any and all content on the online services, such as, but not limited to, text, images, graphics, logos, page headers, button icons, images, audio clips, digital downloads, data compilations, software, trademarks, service marks, trade dress, audio, video, data and other materials (together, "content") as well as any part of the online services. The online services are licensed, not sold, to you. Nothing in these terms intends to transfer any such rights to, or to vest any such rights in, you. You may not take any action to jeopardize, limit or interfere with McDonald's or its licensors' rights.
Your license to use the online services. Subject to these terms, you are granted a personal, non-exclusive, non-transferable and revocable license to use the online services solely for your own personal, non-commercial purposes solely in accordance with these terms. For purposes of clarity, "Use" includes access, interact with, and display. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights these terms expressly grant to you. McDonald's reserves all other rights.
Trademark information. Trademarks, service marks, and all graphical elements, including the look and feel appearing on the online services, are distinctive and protected trademarks or trade dress of McDonald's or licensors. The online services may also contain various third-party names, trademarks, and service marks that are the property of their respective owners.
Acceptable uses and other restrictions. With respect to the online services (which includes content), you may not, and may not allow third parties, to:
Use the online services for any purpose that is unlawful or prohibited by these terms;
Delete or change any copyright, trademark, or other proprietary notices;
Attempt to obtain ownership or title to the online services, including the content;
Use, copy, distribute, republish, display, disclose, upload, post, or transmit the online services in any commercial manner;
Rent, lease, sell, sub-license, loan, translate, merge, adapt, assign or transfer the online services, or combine them with, or incorporate them into, any other programs or services;
Disassemble, decompile, reverse-engineer, copy in source or object code format, or create derivative works based on the online services;
Transfer, provide, export or re-export the online services in violations of an embargo, trade sanction, or other technology control or export laws and regulations; you also represent and warrant that you are not (i) located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a "terrorist supporting" country; or (ii) listed on any U.S. Government list of prohibited or restricted parties;
Use or launch any unauthorized technology or automated system to access the online services or extract content from the online services, including but not limited to spiders, robots, screen scrapers, or offline readers;
Attempt to disable, damage, overburden, impair or gain unauthorized access to the online services, McDonald's network or any user accounts associated with the online services.
Limitations on McDonald's liability. NEITHER McDONALD'S NOR ANY OTHER MEMBERS OF THE McDONALD'S SYSTEM SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT LOST PROFITS OR LOST BUSINESS DAMAGE, SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES, INCLUDING LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE RELATED TO OR ARISING OUT OF THE ONLINE SERVICES. NOTHING IN THIS SECTION IS INTENDED TO LIMIT McDONALD'S LIABILITY FOR DAMAGES TO THE EXTENT CAUSED BY McDONALD'S OWN GROSS NEGLIGENCE OR INTENTIONAL OR UNLAWFUL MISCONDUCT. ADDITIONALLY, NOTHING IN THIS SECTION IS INTENDED TO LIMIT OR ALTER YOUR RIGHTS AS A CONSUMER THAT CANNOT BE LIMITED OR ALTERED UNDER APPLICABLE LAW. McDonald's reserves all legal rights to recover damages or other compensation under these terms or as allowed by law.
McDonald's provides the online services "AS-IS" and without any warranties. The online services may include inaccuracies or errors. McDONALD'S PROVIDES THE ONLINE SERVICES "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED. McDONALD'S DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. McDONALD'S DOES NOT WARRANT OR MAKE ANY REPRESENTATION THAT THE ONLINE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE ONLINE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME TOTAL RESPONSIBILITY RELATED TO YOUR USE OF THE ONLINE SERVICES. YOUR SOLE REMEDY AGAINST McDONALD'S FOR DISSATISFACTION WITH THE ONLINE SERVICES IS TO STOP USING THEM. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.
Third party services. The online services may link to or allow you to use third-party websites, downloadable materials, content, social networks, or other digital services (together, "third party services"). These third parties may have their separate terms and conditions or privacy policies that you should review and understand before using them. McDonald's does not endorse and is not associated with any of these third party services. McDONALD'S HAS NO RESPONSIBILITY FOR ANY LOSS OR DAMAGES ARISING FROM OR RELATED TO THESE THIRD PARTY SERVICES.
Events beyond our control. McDONALD'S HAS NO RESPONSIBILITY FOR McDONALD'S FAILURE TO PERFORM ANY OF ITS OBLIGATIONS UNDER THESE TERMS CAUSED BY OR RELATED TO ANY EVENT BEYOND MCDONALD'S REASONABLE CONTROL. If such an event occurs, then McDonald's obligations under these terms will be suspended for the duration of the event; and McDonald's may, but is not required to, use reasonable endeavors to find a solution by which its obligations under these terms may be performed despite the event.
These terms incorporate and supplement the Apple, Inc. ("Apple") terms and Conditions (available at http://www.apple.com/legal/itunes/us/terms.html#service), including the Licensed Application End User terms therein ("Apple terms") and the Google Inc. ("Google")/ Google Play terms and Conditions (available at http://play.google.com/about/play-terms.html). If you are using the online services through Apple application or Google application, you also acknowledge and agree: Apple/ Google has no obligation at all to provide any support or maintenance services in relation to the Apple/ Google Application. If you have any maintenance or support questions in relation to the Apple/ Google Apps, please contact McDonaldss, not Apple/ Google, using the above Support Services details; except as otherwise expressly set out in these terms, any claims relating to the possession or use of the Apple/ Google Application are between you and McDonald's (and not between you, or anyone else, and Apple/ Google); in the event of any claim by a third party that your possession or use (in accordance with these terms) of the Apple/ Google Application infringes any intellectual property rights, Apple/ Google will not be responsible or liable to you in relation to that claim;
If the Apple/ Google Application that you have purchased does not conform to any warranty applying to it, you may notify Apple/ Google, which may refund the purchase price of the Apple/ Google Application to you subject to then-current Apple/ Google terms and conditions. Subject to that, and to the maximum extent permitted by law, Apple/ Google does not give or enter into any warranty, condition or other term in relation to the Apple/ Google Application and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the Apple/ Google Application or as a result of you or anyone else using the Apple/ Google Application or relying on any of its content.
McDonald's makes no representation that the online services are appropriate or available outside of the Taiwan (R.O.C.). If you use the online services from other locations you are responsible for compliance with applicable local laws.
These terms will be governed and interpreted pursuant to the laws of Taiwan (R.O.C.), notwithstanding any principles of conflicts of law. You irrevocably consent to the exclusive jurisdiction and venue in Taiwan Taipei District Court for purposes of any legal action arising out of or related to these terms or the online services.
Although these terms govern the online services as between McDonald's and you only (and although Apple/ Google is not a party to, and no other Members of the McDonald's System are parties to these terms), Apple/ Google and other Members of the McDonald's System are third party beneficiaries under these terms and will have the right to enforce against you those rights that McDonald's holds under these terms to the extent such terms may pertain to them.
These terms and conditions are written in Chinese. Any translation of these terms and conditions into another language is provided solely for your convenience, and in the event of any discrepancy between the two, the Chinese version will prevail.
On termination of these terms or of your permission to use the online services, all rights granted to you under terms shall cease; however, these terms will continue to apply to your prior use of the online services and anything relating to or arising from such use. Upon termination, all of rights of McDonald's and other Members of the McDonald's System, including all intellectual property rights, proprietary rights, and licenses in these terms shall survive, as well all restrictions on use, all limitations on liability and disclaimers, and all about governing law and jurisdiction of this Section 8.
Each of the terms and conditions in these terms are severable and operate separately. If any of them are unlawful, void or unenforceable, then the remaining terms and conditions will remain in full force and effect.
If McDonald's fails to insist that you perform any of your obligations under these terms, or if McDonald's does not enforce its rights against you, or delays in doing so, that will not mean that McDonald's has waived its rights against you and will not mean that you do not have to comply with those obligations.
McDonald's may transfer its rights and obligations under these terms to another organization or entity, but this will not affect your rights or our obligations under these terms. You may only transfer your rights or obligations under these terms to another person if McDonald's agrees in writing.
